(A) Terms used in this code, unless otherwise specifically defined, have the meanings prescribed by the statutes of the state for the same terms.
(B) All words used in this code indicating the present tense shall not be limited to the time of adoption of this code but shall extend to and include the time of the happening of any event or requirement for which provision is made herein.
(C) The singular number shall include the plural, the plural number shall include the singular, and the masculine gender shall extend to the feminine gender and the neuter.
(D) All references to section numbers shall refer to section numbers of this code.
(E) For the purpose of this code, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ADOPTING ORDINANCE. The ordinance of the municipality adopting the codified ordinances of the city, pursuant to law.
AUTHORITY. Whenever in these codified ordinances authority is given to an officer or an act is required to be performed, such authority may be exercised and such act may be performed, at the instance of such officer, by a deputy or subordinate, unless contrary to law or to the clear intent of any such particular provision.
CITY. The City of Negaunee, Michigan.
CITY COUNCIL or COUNCIL. The City Council of the City of Negaunee.
CLERK. The Clerk of the City of Negaunee.
CODE. The Negaunee Code, as designated in § 10.01.
COMPUTATION OF TIME. The time within which an act is to be done, as provided in this code or in any order issued pursuant to this code, when expressed in days, shall be computed by excluding the first day and including the last, except that if the last day be Sunday or a legal holiday it shall be excluded; and when the time is expressed in hours, the whole of Sunday or a legal holiday, from midnight to midnight, shall be excluded.
CORPORATE LIMITS. Wherever in these codified ordinances an act is prohibited, declared unlawful or required to be performed, directly or by implication, such references shall imply “within the corporate limits of the city.”
COUNTY. Marquette County, Michigan.
GENERAL RULE. Except as otherwise provided in this section, words and phrases shall be construed according to the common usage of the language, provided, however, that technical words and phrases and such others as may have acquired a special meaning in the law shall be construed according to such technical or special meaning.
JOINT AUTHORITY. Words giving authority to a board, council, authority or three or more officers or employees or other persons shall be construed as giving authority to a majority thereof, unless otherwise specifically provided.
JUVENILE. Any person under 17 years of age.
KEEPER and PROPRIETOR. Persons, firms, associations, corporations, clubs and copartnerships, whether acting by themselves or as a servant, agent or employee.
LAND AND REAL ESTATE. Include rights and easements of an incorporeal nature.
LAW or GENERAL LAWS OF THE STATE. The Constitution and Public Acts of Michigan in effect at the time the provision of the code containing the reference is to be applied.
MINOR. A person under 21 years of age.
MUNICIPAL CIVIL INFRACTION. An act or omission that is prohibited by this code or any ordinance of the city, but which is not a crime under this code or any other ordinance of the city, and for which civil sanctions, including without limitation, fines, damages, expenses and costs may be ordered, as authorized by Public Act 236 of 1961, Ch. 87, being M.C.L.A. §§ 600.8701 et seq., as amended. A MUNICIPAL CIVIL INFRACTION is not a lesser included offense of any criminal offense in this code.
OFFICER, DEPARTMENT, BOARD AND THE LIKE. Whenever any officer, department, board or other public agency is referred to by title only, the reference shall be construed as if followed by the words “of the City of Negaunee, Michigan.” Whenever, by the provisions of this code, any officer of the city is assigned any duty or empowered to perform any act or duty, reference to the officer shall mean and include the officer or his or her deputy or authorized subordinate.
ORDINANCES. The ordinances of the City of Negaunee and all amendments thereto.
PERSON.
(a) Any natural individual, firm, trust, partnership, association or corporation.
(b) Whenever the word
PERSON is used in any section of this code prescribing a penalty or fine, as applied to partnerships or associations, the word includes the partners, or members thereof, and as applied to corporations the word includes officers, agents or employees thereof who are responsible for any violations of the section. The singular includes the plural. The masculine gender includes the feminine and neuter genders.
PREMISES. When used as applicable to property, extends to and includes land and buildings.
PROPERTY. Real and personal property and any mixed and lesser estates or interests therein. “Personal property” includes every kind of property except real property; “real property” includes lands, tenements and hereditaments.
PUBLIC ACTS. Acts of the state legislature of the State of Michigan.
PUBLIC PLACE. Any street, alley, park, canal, waterway, beach, public building or any place of business or assembly open to the public or frequented by the public.
STATE. The terms THE STATE or THIS STATE shall be construed to mean the State of Michigan.
STATUTE. The Public Acts of Michigan in effect at the time the provisions of the code containing the reference is to be applied. All references to specific Public Acts shall be to the acts as are in effect at the time the reference to the act is to be applied.
TIME STANDARD. Whenever certain hours are named in this code, they shall mean standard time or daylight saving time as may be in current use in the city.
WRITTEN or IN WRITING. Includes any representation of words, letters or figures, whether by printing or otherwise.
