3-1-3: OBSTRUCTIONS TO PUBLIC WAYS:
If any person shall hereafter obstruct, fence, dig or in any way interfere with any of the streets, lanes, alleys or sidewalks of the city, he shall forfeit and pay to the city a sum of not less than twenty five dollars ($25.00) nor more than five hundred dollars ($500.00) for each and every such offense, to be recovered as other penalties for violation of ordinances of the city are recovered; and all persons advising or counseling, or in any way aiding or assisting in obstructing, fencing, plowing or digging said streets, lanes, alleys or sidewalks, shall be subject to the same penalties as those who may obstruct, fence, plow, dig or in any way interfere with any of said streets, lanes, alleys or sidewalks. The city attorney and city marshal are hereby directed to prosecute any and all persons who shall be guilty of violating this section; provided, that this section shall not apply to any person acting under the direction or order of the city council, street superintendent or mayor, or any person authorized by ordinance of the city to oversee or work said streets, alleys, lanes or sidewalks.
