5-1-4: ABATEMENT PROCEEDINGS IN GENERAL:
   A.   Duty To Report: Any person or entity that has standing to complain under this chapter shall report the fact of the nuisance and the details surrounding it to the Mayor, City Council, and/or City Nuisance Committee; if that nuisance complaint is justified under the circumstances, the City may institute abatement proceedings in accordance with this chapter or State law. In order to determine whether the nuisance complaint is justified, a representative of the City may enter upon the property to determine the nature and extent of the violation.
   B.   Written Notice: If the nuisance does not threaten immediate danger to persons or property, the City shall issue a notice to the premises' occupant and to the owner. The notice shall identify the property, describe the nature of the nuisance, and state the date (for example, within 3 days from the date of receipt of the notice) that the abatement must be completed.
   C.   Service Of Notice: If the property in violation is occupied, then the notice of violation shall be served upon the occupant by personal service or by mail (with delivery confirmation). If the occupant is not the owner, a copy of the notice also shall be served upon the owner by personal service or by mail (with delivery confirmation). However, if the property is unoccupied or vacant, then the notice shall be served upon the owner by mail (with delivery confirmation) at his last known address. If the owner's address is unknown, then the notice shall be served by posting it on the property.
   D.   Abatement By City: If the owner or occupant fails to abate the nuisance within the time period provided for in the notice, or as extended by the City, then the City, by its employee, agent, or other designee, is authorized to enter upon the property upon which the public nuisance exists and abate the nuisance, including removing the nuisance and performing any related clean- up and debris removal. The City also may file an action in the Circuit Court and request an order compelling the occupant and/or owner to abate the nuisance and to pay all expenses related to the abatement, including the administrative fee, attorney fees, and court costs.
