3-2-1: HEDGE FENCES:
   A.   Prohibited Conditions:
      1.   It shall be unlawful for any person to permit any trees, shrubs, hedge fences or any Osage hedge fence to overhang the public streets, alleys, avenues, lanes or sidewalks of the city.
      2.   It shall be unlawful for any person to permit any trees, shrubs, hedge fence or any Osage hedge fence to obstruct or encroach upon any public street, alley, avenue, lane or sidewalk of the city.
      3.   It shall be unlawful for any person to leave any trimmings or cuttings from any trees, shrubs, hedge fence or Osage hedge fence on any public street, alley, avenue, lane or sidewalk of the city more than twenty four (24) hours after the same shall have been cut, if it has been properly marked.
   B.   Trimming Required: All shrubs, hedge fences or Osage hedge fences within the corporate limits of the city shall at all times be kept closely trimmed. In case any shrubs, trees, hedge fence or Osage hedge fence shall overhang or obstruct any public street, alley, avenue, lane or sidewalk of the city, the city marshal shall notify the owner or occupant of the lot on which such trees, shrubs, hedge fence or Osage hedge fence is situated, forthwith to trim or cause to be trimmed, such trees, shrubs, hedge fence or Osage hedge fence in proper shape, as provided herein, and in case the owner or occupant of such lot shall not, within twenty four (24) hours from the time of being so notified by the marshal, proceed to trim or remove such hedge, trees, shrubs or Osage hedge overhanging, encroaching or obstructing as aforesaid, the street superintendent as notified by the city marshal shall have power and authority, and it is hereby made his duty to proceed to trim or remove such parts of said trees, shrubs, hedge fence or Osage hedge fence overhanging, encroaching or obstructing as aforesaid, the expense of such trimming or removal to be paid by the owner or occupant of such lot.
   C.   Penalty: Whoever shall violate any of the provisions of this section shall, on conviction thereof, be fined not less than fifty dollars ($50.00) nor more than two hundred fifty dollars ($250.00) for each offense. (Ord. 170, 5-2-1921; amd. 1989 Code; 1991)
