§ 151.096 GRADING, LANDSCAPING, AND EROSION AND SEDIMENTATION CONTROL.
   In the construction of any subdivision or development, the requirements of the minimum design standards and the following erosion and sedimentation control regulations shall be complied with for grading, landscaping, and all construction activities that disturb natural groundcover.
   (A)   The subdivision or development shall conform to all natural limitations presented by topography and soil so as to create the least potential for soil erosion.
   (B)   Large trees (those having a diameter of four inches or more when measured 12 inches above the ground) shall be retained and protected to the maximum extent consistent with development of the site.
   (C)   Land shall be developed in the smallest increments of workable size so that adequate erosion and sediment controls can be provided and coordinated with ongoing construction work. When soil is exposed, the exposure shall be for the shortest feasible period of time.
   (D)   Temporary vegetations, or where appropriate, mulching or other nonviable cover shall be used to protect areas exposed during development and construction.
   (E)   (1)   Adequate provisions shall be made to effectively accommodate the increased stormwater runoff volume and runoff rate caused by changed soil and surface conditions both during and after development.
      (2)   Appropriate devices, such as sediment basins, debris basins, desilting basins, or silt traps, shall be installed and maintained to remove sediment from surface waters leaving the subdivision or development.
   (F)   No lot shall be occupied until:
      (1)   Grading has been completed in accordance with the minimum design standards and accepted improvement plans; and
      (2)   At least four inches of topsoil equal in quality to the soil that was on-site prior to development has been spread over open areas not occupied by buildings, paving, and other improvements.
