§ 151.040 ACCEPTANCE OR NONACCEPTANCE BY PLANNING COMMISSION.
   (A)   The Planning Commission shall either accept or not accept the application for preliminary plat within 90 days from the date of said application or filing of the last item of required supporting data, whichever is later, unless the Planning Commission and subdivider/developer mutually agree to extend this time limit.

   (B)   If the Planning Commission does not accept the preliminary plat, it shall furnish to the applicant within the 90-day period a written statement specifying the aspects in which the proposed preliminary plat fails to conform to this subchapter and/or the official map. If the Planning Commission accepts the preliminary plat, it shall promptly so inform the governing body of the municipality.
