§ 55.99 PENALTY.
   (A)   Any excavator causing damage to the city’s underground pipeline facilities shall pay all costs associated with the value of the lost product, including, but not limited to, natural gas, potable water, raw water, stormwater, and domestic sewerage; all costs associated with the physical repair of the pipeline, including material, labor, equipment, engineering, and testing costs; all costs associated with damages and repairs to the environment and environmental mitigation costs; and any fines assessed to the city by the IEPA, USEPA, or any other governmental agency resulting from the damage event.
   (B)   A fine not to exceed $750 as set by the City Council on a case-by-case basis. If not paid by the offender within 30 days of notice of its imposition, the city shall prosecute the offense in County Circuit Court with a fine not to exceed $750.
