133.03 LAND USE AND UTILITY SERVICE AGREEMENTS.
   (a)   The City Manager is authorized to enter into and execute, on behalf of the City, land use license agreements concerning City property or rights-of-way without prior specific approval of Council; such agreements shall be in a form approved by the City Law Director.
   (b)   The City Manager is authorized to enter into and execute, on behalf of the City, land use license agreements when private property is required for a City need without prior specific approval of Council; such agreements shall be in a form approved by the City Law Director.
   (c)   The City Manager is authorized to enter into and execute, on behalf of the City, routine utility connection and service agreements without prior specific approval of Council; such agreements shall be in a form approved by the Law Director.
   (d)   Subject to appropriation of funds, the City Manager is authorized to hire appraisers, title attorneys and negotiators; further, to negotiate, purchase, acquire and accept, on behalf of the City, easement in land(s) when such property is required for present or future utilities, operations, or other City business without further approval of Council, except that any acquirement of easement costing in excess of the contractual amounts established in Section 105.03 shall require specific Council approval. Any easement acquired by the City shall be in a form approved by the City Law Director.
   (e)   Subject to appropriation of funds, the City Manager is authorized to hire appointees, title attorneys and negotiators; further, to negotiate, purchase, acquire and accept on behalf of the City, deed to land(s) when such property is required for present or future utilities, operations, or other City business, without further approval of Council, except that any acquirement of land costing in excess of the expenditure amounts established by Council requiring Council approval shall stand. Any deed acquired by the City shall be in a form approved by the City Law Director. (Ord. 32-01. Passed 5-7-01.)
