(a) Existing signs which do not conform to the specific provisions of the Sign Code may be eligible for the designation "legal nonconforming" provided that:
(1) The Administrator determines such signs are properly maintained and do not in any way endanger the public; and
(2) The sign was installed in conformance with a valid permit or variance, or complied with all applicable laws on or before July 19, 2006; or
(3) The sign was legal at the time the property where the sign is located was annexed into the City.
(b) As it relates to Section 1335.19(a)(2), a presumption exists that the designation of “legal nonconforming” is not present in the event that the Administrator has no records verifying a valid permit or variance.
