Such fees as paid and collected pursuant to Section 909.01 shall be retained by the City pending action of Council thereon; however, if Council does not vacate the street, avenue, way, place or alley so petitioned to be vacated, then all amounts paid (as described in said Section 909.01) by the petitioner(s) shall be refunded, excluding the twenty-five dollar ($25.00) application fee and publication costs, with no interest due.
