§ 52.17 PRIVATE SEWAGE DISPOSAL SYSTEM; WHEN AUTHORIZED; REQUIREMENTS.
   (A)   Where a public sanitary sewer is not available under the provisions of § 52.10. the building sewer shall be connected to a private sewage disposal system complying with the provisions of this chapter.
   (B)   Before commencement of construction of a private sewage disposal system the owners shall first obtain a written permit signed by the Village Clerk or the authorized agent of the governing body. The application for such permit shall be made on a form furnished by the Village Clerk, which the applicant shall supplement by any plans, specifications and other information as are deemed necessary by the Governing Body. A permit and inspection fee of $250 shall be paid to the Village Clerk/Treasurer at the time the application is filed.
   (C)   A permit for a private sewage disposal system shall not become effective until the installation is completed to the satisfaction of the governing body or its authorized agent. He shall be allowed to inspect the work at any state of construction, and in any event, the applicant for the permit shall notify the governing body through the Village Clerk when the work is ready for final inspection and before any underground portions are covered.
   (D)   The type, capacities, location and layout of a private residential sewage disposal system shall comply with all requirements of the appropriate division of the Nebraska Department of Environmental Quality Title 124 Rules and Regulations for Design, Operation and Maintenance of Septic Tank Systems, County Department of Health and the local health officer. No permit shall be issued for any private sewage disposal system employing subsurface soil absorption facilities where the area of the lot is less than that recommended by abovementioned agencies. No septic tank or cesspool shall be permitted to discharge to the surface of the ground or to any natural outlet.
   (E)   At such time as a public sewer becomes available to a property served by a private sewage system, as provided in § 52.10, a direct connection shall be made to the public sewer in compliance with this chapter, and any septic tank, cesspools and similar private sewage disposal facilities shall be abandoned within 180 days and removed or filled with suitable materials. Abandonment shall be done in accordance with Nebraska Department of Environmental Quality Title 124 Rules and Regulations for the Design, Operation and Maintenance of Septic Tank Systems.
   (F)   The owner shall operate and maintain the private sewage disposal facilities in a sanitary manner at all times, at no expense to the municipality.
   (G)   No statement contained in this chapter shall be construed to interfere with any additional requirements that may be imposed by the health officer.
   (H)   When a public sewer becomes available, the building sewer shall be connected to said sewer within 90 days and the private sewer disposal system shall be cleaned of sludge and filled with clean bank run gravel or dirt.
