§ 32.95 DUTIES AND RESPONSIBILITY.
   (A)   It shall be the responsibility of the Board to study, investigate, and develop and/or update annually and administer a written plan for the care, preservation, pruning, planting, replanting, removal or disposition of trees and shrubs in parks, along city streets, and in other public areas. The Board shall determine the types and species of trees suitable for planting, as well as those prohibited, and the conditions under which such trees shall be planted along streets, parks, cemeteries and public places within the city. When completed, the plan shall be presented to the City Council for their approval. Upon acceptance by the City Council of such plan, the plan shall constitute the official comprehensive city tree plan for the city. The Board, when requested by the City Council, shall consider, investigate, and make findings, reports and recommendations upon any special matter of question coming within the scope of its work.
   (B)   The comprehensive city tree plan may include, but is not limited to, designation of the types and species of trees suitable for planting in public areas; any necessary and suitable protective barriers to be placed around trees to prevent damage thereto; any regulations concerning draining or dumping around trees in public areas; any regulations concerning the construction of improvements around or near to trees in public areas or any other regulations which the City Tree Board deems necessary for the care and preservation of trees along streets and in other public areas.
