For the purpose of this subchapter, the following definition shall apply unless the context clearly indicates or requires a different meaning.
"TREE." Any woody plant which meets any one of the following criteria:
(1) Has a trunk four inches or more in diameter at one foot above the ground; or
(2) Is of a horticultural variety or is highly ornamental (such as a dogwood, redbud, crab apple, sourwood, flowering cherry or peach, southern magnolia, holly, and the like) and has a trunk diameter of three inches or more at one foot above the ground, or has attained a capable stature of flowering and reproducing.
