§ 117.35 ADULT ORIENTED BUSINESS EMPLOYEE LICENSE.
   (A)   All employees of an Adult Oriented Business are required to obtain an Adult Oriented Business Employee License. Each applicant shall pay a non-refundable application fee of one hundred dollars ($100.00) to cover reasonable administration costs.
   (B)   On a form provided by the city the applicant shall provide his:
      (1)   Name, including any "stage" names or aliases;
      (2)   Age, birthdate and birthplace;
      (3)   Current resident and business addresses and phone numbers;
      (4)   Height, weight, hair and eye color;
      (5)   State driver's license or identification number and social security number;
      (6)   Proof of a minimum age of eighteen (18);
      (7)   A passport-type color photograph and fingerprints on a form provided by the Police Department;
      (8)   A statement detailing the license or permit history of the applicant for the previous five years including information as to whether a permit has ever been denied, revoked or suspended, the reason for such action, the date of such action, and the jurisdiction in which such action occurred;
      (9)   Information as to whether the applicant has been convicted of a "specified criminal act" as defined in § 117.02 and the date, place, jurisdiction and nature of such conviction; and
      (10)   Information concerning any other business or professional licenses or permits held by the applicant.
      (11)   The applicant shall describe with particularity and in detail the nature and extent of the activity or activity to be engaged in at the Adult Oriented Business.
      (12)   Applicants are under a continuing duty to promptly update their application information in the event that it changes in any way from what is stated on the application. Failure to so supplement within thirty (30) days of the date of a change in application information shall be grounds for permit suspension.
      (13)   A current city, county, state and federal criminal records check that covers the time period from five (5) years prior to the date of the application. If the applicant resided in a state other than Kentucky during the last five years prior to the date of application, current records checks from all other states of residence must be included. A current criminal records check is one completed not more than fourteen (14) days prior to the date of the application.
      (14)   A signed release indicating the applicant's understanding that city, county, state and federal criminal records checks, going back five (5) years before the date of the application, will be performed for the applicant and each individual named in the application and verified by the city.
   (C)   By filing an application under this Section, the applicant shall be deemed to have consented to the provisions of this chapter and to the investigation of the application by the City Administrator and his designees.
   (D)   The application review shall be completed within twenty-one (21) days of filing. The employee license shall be issued unless the city finds that:
      (1)   The applicant knowingly made a false, misleading or fraudulent statement of material fact;
      (2)   The applicant is under eighteen (18) years of age;
      (3)   The applicant has been convicted of a "specified criminal act" as defined in § 117.02, within either two (2) years for misdemeanor offense, or five (5) years for felony offenses or two (2) or more misdemeanor offenses, immediately preceding the application date, and, if so, the act involved and the date and place of the conviction;
      (4)   The applicant has had an employee license revoked within two (2) years of the date of the current application.
      (5)   The one hundred dollar ($100.00) application fee has not been paid.
   (E)   The license shall be valid upon issuance of same and the payment of a thirty dollar ($30.00) annual license fee. This license shall be in effect for the period of one (1) year from the date of issuance. This license shall not be transferable to any other person during the period of the license and the fee is charged to offset the city's expenses in issuing the license.
   (F)   An employee license may be renewed annually upon written application subject to the payment of a fifty dollar ($50.00) renewal fee and a finding that the applicant is still in conformance with the application requirements. This renewal fee is in addition to the annual license fee provided in subsection (E).
