§ 94.06 CONSIDERATION FOR PERMIT APPROVAL; NOTICE OF APPROVAL OR DENIAL; APPEAL; REVOCATION OF PERMIT.
   (A)   The City Manager, or his/her designee, may issue a special event permit or special event permit with alcohol, based on, but not limited to, the following considerations:
      (1)   Health, welfare and safety of the general public;
      (2)   Availability of municipal services (such as police, fire, engineering, inspection and sanitary services);
      (3)   Traffic flow; and
      (4)   Availability of use of the area by the general public.
   (B)   The City Manager shall act upon the application for a special event permit or special event with alcohol permit within fourteen (14) days after the filing thereof. Upon approval of the special event permit or special event with alcohol permit, the City Manager shall send a copy thereof to the applicant and appropriate city departments and other agencies as deemed necessary by the City Manager.
   (C)   If the City Manager denies the application, he/she shall deliver to the applicant a notice of denial, stating his/her reasons for denial of the permit.
   (D)   Any applicant aggrieved by the denial of their permit may file an appeal with the city's General Appeal Board. Such appeal shall be made within a period of ten (10) days following the applicant's receipt of the denial of application. To perfect the appeal, the aggrieved applicant shall provide written notice of appeal to the City Clerk within the aforesaid ten (10) day period. The Appeal Board shall conduct a hearing on such appeal within thirty (30) days following receipt of the written notice of appeal by the City Clerk.
   (E)   In the event a permit is approved and applicant fails to meet any of the considerations set forth in this chapter, the City Manager retains the authority to revoke the applicant's permit. Further, the Chief of Police and Fire Chief shall have the authority to, at any time, revoke or suspend a special event permit or special event with alcohol permit for an indefinite period of time under exigent circumstances or the threat thereof, which present a reasonable concern for public safety.
