§ 51.07 PROPERTY OWNER'S RESPONSIBILITIES.
   (A)   No property owner shall cause, or permit, any installation, construction, reconstruction and/or repair of any gas house piping in the city and its gas service territory without first engaging the services of a licensed gas professional.
   (B)   Property owner and/or customer responsibilities. Within the city and its gas service territory, the construction, installation, reconstruction and repair of all customer piping, gas appliances, gas furnaces, equipment, fixtures and apparatus, located inside the structure and/or attached to the customer side of the meter are the sole responsibility of the customer and/or the licensed gas professional selected by the customer. MNG's responsibility stops at the meter installed by MNG. Customers maintain sole and absolute responsibility for maintenance, repair, inspection and installation, and for having appliances and piping on the customer side of the meter checked periodically for leaks and good functionality by the licensed gas professionals of their choice.    (C)   Institutional customers, including, but not limited to, schools, universities, hospitals, and industrial plants, that are composed of multiple buildings and structures utilizing gas piping, fixtures and appliances throughout the institution and/or who employ specialized licensed gas personnel to install, repair, maintain and/or operate the institution's natural gas system, on a daily basis, shall be solely responsible for repairs, replacement, scheduled inspections, maintenance, and monitoring of any and all gas lines and apparatus downstream from the customer meter as well as all natural gas utilizing equipment in the entity's gas system, including, but not limited to, boilers, furnaces, powerhouses, industrial ovens, coolers, condensers, and refrigeration systems. All design, construction, installation, reconstruction, repair, replacement, maintenance and inspection of any type conducted by the institutional customer shall be done according to the NFPA 54 ANSI Z223.1, National Fuel Gas Code, and all applicable state and federal regulations as well as the city code. MNG shall maintain full responsibility for the provision of the distribution service line up to and including the meter. The customer bears total responsibility for all customer piping. Further, MNG shall remain available for consultation regarding potential gas leaks and other situations deemed potentially hazardous and, in those cases where imminent danger has been determined to exist.
   (D)   If state or federal rules and regulations, NFPA 54, ANSI Z223.1 National Fuel Gas Code or Murray Code of Ordinances are not, in the sole and absolute discretion of MNG, being adhered to by the institutional customer or if MNG, in its sole and absolute discretion, has concerns regarding the manner in which the institution's gas system is being managed or monitored, the city reserves the right to master meter the institution, effectively placing them under the regulatory authority of the Public Service Commission (PSC) for the State of Kentucky. The city would identify a boundary where meters would be set and read, leaving the regulatory requirements inside the boundary to the PSC.
   (E)   No property owner or any other person or entity may build any type of structure, whether permanent or temporary, on top of an existing gas line. If any person or entity builds any structure over a gas line within the city's natural gas service territory in violation of this chapter, MNG shall relocate the line to an appropriate location unencumbered with building or structure and do so at the property owner, person or entity's expense and a civil penalty may be charged according to city code § 51.99(A).
   (F)   The City of Murray reserves the right to require the property owner and his/her licensed gas professional to rectify any infraction of the rules, even though the work has passed licensed gas professional and MNG evaluation and a final certificate of compliance so verifying has been issued.
