§ 152.28 VARIANCES.
Where, because of severe topographical or other conditions peculiar to the site, strict adherence to the provisions of this chapter would cause an unnecessary hardship, the Subdivision Administrator may, following proper notice and a quasi-judicial hearing, authorize a variance to the terms of this chapter only to the extent that is absolutely necessary and not to an extent which would violate the intent of this chapter. The reasons for the granting of a variance shall be clearly specified and entered into the minutes of the Board of Commissioners.
