§ 93.01 GENERALLY.
   (A)   Violations. 
      (1)   It shall be unlawful and a violation of the provisions of this section for any person, firm or corporation to construct, set, place, keep, or maintain, or permit to be constructed, kept, set, placed, or maintained any temporary or nonpermanent sign, billboard, bulletin board, or marquee closer to any adjacent street or highway than ten feet back of the right-of-way of the street or highway within the corporate limits of the town.
      (2)   It shall be unlawful and a violation of the provisions of this section for any person, firm or corporation to construct, set, place, keep, or maintain, or permit to be constructed, set, placed, kept, or maintained any temporary or nonpermanent sign, billboard, bulletin board, or marquee in the following areas located on each corner of the public square within the corporate limits of the town to wit:
         (a)   On or within the pocket park located adjacent to and southeast of the intersection of Peachtree Street and Valley River Avenue or on any of the sidewalks or walkways adjacent to or within this pocket park.
         (b)   On or within the pocket park located adjacent to and northeast of the intersection of Valley River Avenue and Tennessee Street or on any of the sidewalks or walkways adjacent to or within this pocket park.
         (c)   On or within the pocket park located adjacent to and northwest of the intersection of Tennessee Street and Hiwassee Street or on any of the sidewalks or walkways adjacent to or within this pocket park.
         (d)   On or within the pocket park located adjacent to and southwest of the intersection of Peachtree Street and Hiwassee Street or on any of the sidewalks adjacent to this pocket park.
      (3)   The following signs are exempt from the requirements of this section: all classes of government signs including but not limited to traffic, health and public safety, crime control and prevention, and official notices or advertisements related to any court action, notice of the location of underground utilities, historical markers or monuments, and any other community service sign approved by the Board of Commissioners of the town.
   (B)   Enforcement. It shall be the duty of the Police Department of the town to enforce the provisions of this section.
   (C)   Exercise of police power. This entire section shall be deemed and construed to be an exercise of the police power of the town for the preservation and protection of public safety, and all of its provisions shall be liberally construed with a view the effectuation of the purpose.
