(A) No person shall stand in a roadway for the purpose of soliciting a ride, employment, or business from the occupant of any vehicle.
(B) No person shall stand on or in proximity to a street or highway for the purpose of soliciting.

Notwithstanding the foregoing provisions of this subchapter, every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian upon any roadway; shall give warning by sounding the horn when necessary; and shall exercise proper precaution upon observing any child or any confused or incapacitated person upon a roadway.

The use of the unnamed alley located 93 feet northeast of and parallel to Peachtree Street extending northwest from the northwest boundary of that certain tract or parcel of land conveyed by the deed from Wachovia Bank and Trust Company, N.A., to Cherokee County dated April 6, 1973, and recorded in Book 321 at Page 112 in the Office of the Register of Deeds of Cherokee County, North Carolina, to the southeast boundary of that certain tract or parcel of land conveyed by the deed from Parker’s Drug Store, Inc., to Sociedad Commercial Siena Ltda, a foreign corporation organized under the laws of the County of Chile, dated February 27, 2015, and recorded in Book 1507 at page 631, in the office of Register of Deeds of Cherokee County, North Carolina, be and hereby is limited to pedestrian use only and vehicular traffic thereon be and hereby is prohibited.
