§ 51.42 PRIVATE SEWER LINE REPAIR.
   (A)   Repair of private sewer lines. The Town of Murphy is hereby authorized to repair or replace any broken, damaged, or otherwise inoperable private sewer line or pipe located on private property, which private sewer line or pipe is connected to the sewer collection and disposal system of the Town of Murphy, North Carolina, upon failure of the owner of the private sewer line or pipe to repair or replace same within five days after having been requested to do so by the Town of Murphy.
   (B)   Cost of repair or replacement. The owner of any private sewer line or pipe which is repaired or replaced by the Town of Murphy pursuant to the provisions of this section shall be liable to the Town of Murphy for the cost thereof, including the cost of labor and the cost of materials, to repair or replace the private sewer line or pipe.
   (C)   Right to enter. All duly authorized employees of the Town of Murphy bearing proper credentials and identification shall be permitted to enter upon all properties for the purpose of repairing and/or replacing private sewer lines or pipes in accordance with the provisions of this section.
   (D)   Implementation. It shall be the duty of the Town Manager to implement the terms and provisions of this section.
