(A) No street or road shall be accepted by the City Council for city maintenance unless 25% of the abutting property owners petition the City Council for city maintenance. The City Council, within 30 days thereafter, shall hold a public hearing on the petition. If 50% of the abutting property owners agree in writing to accept city maintenance, the City Council may maintain the road or street if the Council decides the same would be beneficial to the public interest.
(B) The petition in division (A) above shall contain the following items, which are to be considered as minimum standards:
(1) A copy of all property owners' deeds and a certification of title certifying good, marketable, and fee simple title in the petitioning property owners proposing to dedicate the public way to the city.
(2) The names and addresses of all other persons owning property abutting the road or street.
(3) Surveyed centerline and legal description of the property, and filed therewith a plat, more particularly described in § 154.02(M), of the territory bounded, intersected, or immediately adjacent to the road or street, showing the proposed name, nature, and dimensions of the same, which shall be in compliance with city requirements, and which requirements are detailed in § 154.02.
