§ 152.38 VEHICULAR ACCESS BY ABUTTING OWNERS.
   (A)   Owners of property which abuts an unimproved alley or street may use such abutting unimproved alley or street for occasional vehicular access without a permit, provided that:
      (1)   Personal property, trees and landscaping of another abutting property owner are undisturbed;
      (2)   Vehicular access is avoided when likely to result in ruts or damage to turf on account of the condition of the unimproved alley or street; and
      (3)   Any and all ruts or damages to the turf are repaired and the unimproved alley or street is restored to its condition prior to vehicular access.
   (B)   Vehicular access by an owner of property which abuts an unimproved alley or street beyond occasional access under the conditions described in division (A) above is prohibited without the prior written permission of the Town Council upon terms and conditions which may include improvement of the unimproved alley or street or part thereof in accordance with design standards approved by the Town Council, entry of a maintenance agreement, bonding for maintenance and such other conditions as the Town Council may prescribe.
