§ 73.035 SKATEBOARD RAMPS AND PIPES.
   (A)   Definition. For the purpose of this section, the following definition shall apply unless the context clearly indicates or requires a different meaning.
      SKATEBOARD RAMP. All inclined structures designed and principally intended to permit a person riding on a skateboard to ascend the incline for jumping, to ascend and descend the incline or to move from side to side on inclined surfaces. The structures are commonly referred to as ramps or pipes.
   (B)   Construction and location.
      (1)   It shall be unlawful to construct, erect, place or maintain a skateboard ramp on any property within the town, which ramp exceeds six feet in height.
      (2)   It shall be unlawful to construct, erect, place or maintain a skateboard ramp within the right-of-way or traveled portion of any street, or on private property within the town within 20 feet of the nearest edge of any street.
   (C)   Use.
      (1)   In any residential area, it shall be unlawful to charge or to receive any consideration for the use of a skateboard ramp or to use or operate a skateboard ramp in any commercial manner.
      (2)   In any residential area in the town, it shall be unlawful to use any skateboard ramp between the hours of 9:00 p.m. and 7:00 a.m. the succeeding morning.
   (D)   Parental responsibility. It shall be unlawful for the parent or guardian of any child 17 years of age or younger to knowingly permit the child to violate this section.
   (E)   Effective date. The provisions of this section shall apply to any skateboard ramp constructed, erected, placed or maintained on or after the effective date of this section and shall also apply to any skateboard ramp in existence as of the effective date of this section, although the ramp may have been erected, placed or maintained prior to the effective date of this section. In the cases of existing skateboard ramps, the owner of the property upon which the ramp is located shall have a period of 30 days from the effective date of this section to either remove the ramp or bring it in compliance with the provisions of this section.
