§ 150.31 SURFACE WATER DRAINAGE.
   (A)   Any individual prior to initiation of any of the following listed activities on real property within the city shall prepare a drainage plan for the property and obtain approval of the drainage plan by the City Council and bind himself to implementations of the drainage plan at his expense. These activities shall include:
      (1)   Subdivision of real property into multiple tracts.
      (2)   Construction of new buildings or other major site improvements.
      (3)   Construction of major additions or modifications to existing buildings for site improvements.
      (4)   Commencement of any other activity requiring approval of the subdivision plot or site plan by the County Planning Commission.
   (B)   Property owners proposing to construct a single-family residence and related site improvements on individual lots are exempted from the requirement to obtain drainage plan approvals provided that the proposed construction does not obstruct existing drainage ways and does not cause discharge of surface water onto adjacent property outside of existing drainage ways.
   (C)   Property owners shall submit to the City Council drainage plans and shall tender to the city at that time funds to pay the fees to reimburse the city for the cost to review the drainage plans for professional services for recommendation of approval to the drainage plan.
   (D)   The property owner shall post a performance bond to guarantee implementation of the drainage plan submitted to the City Council. Approval of the drainage plan shall be based upon the City Council's determination that the plan will provide proper drainage for the subject property and related property based on the engineering criteria contained in the latest edition of the Kentucky Department of Transportation Manual of Instructions for Drainage Designs.
   (E)   The City Council shall have 21 days to issue a recommendation as to the approval or denial of the drainage plan. Upon a denial the property owner shall be advised of the reasons that the plan was rejected and shall be furnished an opportunity at the regular City Council meeting to voice objections to the City Council's recommendations.
