(a) Sidewalk sales and displays are permitted with the following restrictions:
(1) No display used for such sidewalk sale shall extend more than forty-two inches from the outside wall of the business establishment promoting the sidewalk sale.
(2) There shall be, at all times, a minimum opening of four feet providing access from the business establishment to the public way.
(3) All sidewalk sales and displays of items for sale shall be attended by at least one employee of the merchant presenting the display with the exception of displays of plants and flowers.
(b) Whoever violates this section is guilty of a minor misdemeanor.
