373.14 SIDEWALK OPERATION OF SKATEBOARDS PROHIBITED.
   (a)   No person shall ride a skateboard upon the Square of the City or upon the sidewalks within the central business district of the City (with the exception of the east side of Gay Street south from Chestnut Street within the City of Mount Vernon) or within Moundview Cemetery located within the City.
   (b)   Whenever any skateboard is operated in violation of the provisions of this section, such skateboard may be seized by any member of the Police Department and impounded. The skateboard of any person under the age of eighteen years shall be surrendered to the parent or guardian of such person without charge, after a full explanation to such parent or guardian, of the reason for impounding the skateboard.    (c)   Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
