(a) Applications. For the purpose of administering this Chapter, all soil disturbing projects governed by this Chapter shall be subject to a stormwater management, erosion and sedimentation control permit. The owner, developer, builder, or contractor, or an authorized representative, shall apply for a stormwater management, erosion and sedimentation control permit using a form prescribed by the City Engineer, as directed below:
(1) For soil disturbing projects related to or involving building construction.
(2) For all other soil disturbing activities, including but not limited to site grading, grubbing and land clearing, but not involving building construction.
(3) Unless otherwise exempt no zoning permit shall be issued, and no soil-disturbing activities shall begin until a project stormwater management, erosion and sedimentation control permit has been issued.
(4) Government agencies are not exempt from the permit requirement for under this Chapter.
(b) Permit Processing.
(1) Stormwater management, erosion and sedimentation control permit applications for projects involving building construction shall be completed and filed with the permit fee at the City Engineering Department. The City Engineer shall review the permit application making comment on any necessary corrections to the plan and advise the applicant of the results of the review. When all conditions are met, a stormwater management and sediment control permit will be issued.
(c) Exceptions.
(1) Projects involving LESS than 20,000 square feet of land disturbance are exempt from a permit as noted above; however, these projects shall complete an Agreement with the City using the City's forms.
