Nothing in this chapter shall be construed to such a manner as to confer any responsibility or obligation upon the City or its agencies to pay for or otherwise share the cost of the care, preservation, trimming, planting, replanting, removal or disposition of trees and shrubs in the public ways, streets or alleys. However, the Safety Service Director shall have the authority to authorize tree planting or replanting in the City tree lawn (right of way) within the City of Mount Vernon. Such planting will be discretionary by the Safety Service Director with consideration given to budgetary constraints and the advice of the Shade Tree and Beautification Commission. The Safety Service Director may choose to authorize certain tree planting in the City tree lawn at the request of the adjoining property owner, or upon the advice of the Shade Tree and Beautification Commission. This section does not place any requirement upon the City to replace a tree previously planted by the City.
