1303.11 MODIFICATIONS.
   (a)   When there are practical difficulties involved in carrying out the provisions of the Maintenance Ordinances, and the property owner appeals such an order to the Board, the Board may modify the terms of an order issued by the Property Maintenance Enforcement Officer. Before granting a modification, the Board must first find:
      (1)   That there are special individual facts that make the strict application of the Maintenance Ordinances impractical, and
      (2)   That the modification complies with the intent and purpose of the Maintenance Ordinances, and
      (3)   That the modification does not lessen health, life and fire safety requirements.
   (b)   The specific facts supporting a modification shall be noted in the record and the decision shall be filed with the office of the Safety Service Director.
