1303.06 FEES.
   The fees for Property Maintenance Enforcement shall be set as follows:
   (a)   In any instance where the City incurs expenses because of a property owner or tenant's non-compliance with the Maintenance Ordinances, the expenses incurred, plus an administrative fee equal to the expenses incurred shall be recovered from the property owner or tenant as applicable. If a building is demolished at City expense due to the property owner's non-compliance, the administrative fee shall be $1,000.00.
   (b)   In instances where a property owner or tenant is in violation of the same Ordinance section on the same property on more than one occasion in a 24 month period; and it is necessary for the City to again incur expenses, the property owner or tenant will be assessed a penalty in addition to the expenses and fees in subsection (A) above. The penalties shall be as follows:
      (1)   $ 50.00 for the second occurrence
      (2)   $100.00 for the third occurrence
      (3)   $150.00 for any subsequent occurrence in a 24 month period
   (c)    In instances where a property owner or tenant receives three notices for being in violation of any Ordinance section of the Maintenance Ordinances on the same property in one calendar year (January 1 - December 31), a penalty not to exceed $1,000 will be assessed with receipt of the third or subsequent violation notice. This penalty is in addition to any other actions that may be taken against the property owner or tenant.
   (d)    In instances where a property owner or tenant fails to remedy their violations in the time period prescribed, the Property Maintenance Enforcement Officer may assess the property owner or tenant a penalty in the amount of $100 per day until the violation is corrected. This penalty is in addition to any other actions that may be taken against the property owner or tenant. (Ord. 2019-10. Passed 2-25-19.)
   (e)   Any person making an appeal to the Property Maintenance Appeals Board must pay an administrative fee of $100.00 at the time the appeal is filed, unless it is an appeal of an emergency order under Section 1303.08(e).
   (f)   If a property owner removes a placard declaring that a building has been condemned by the Property Maintenance Appeals Board, the property owner shall be charged a fee of $100.00 for re-placarding the property.
   (g)   Fees and penalties may be waived, if in the judgment of the Property Maintenance Appeals Board, the fees and penalties are not warranted by the circumstances.
