(a) When the Property Maintenance Enforcement Officer has reasonable cause to believe that a structure or premises is in violation of one or more of the Maintenance Ordinances, he shall identify the nature of the violation(s), present credentials to the occupant of the premises, and request to walk around the exterior of the property. If the premises are unoccupied, the Property Maintenance Enforcement Officer shall make a reasonable effort to locate the owner or other person having control of the premises. Upon locating the owner or person having control, the Property Maintenance Enforcement Officer shall identify the nature of the violation(s), present credentials to the occupant of the premises, and request to walk around the exterior of the property.
(b) The Property Maintenance Enforcement Officer may request the Law Director to seek a search warrant from a court of competent jurisdiction:
(1) If a request to walk around the exterior of the property is denied, or
(2) If the Property Maintenance Enforcement Officer cannot locate the owner or person with control of the premises, or
(3) If the Property Maintenance Enforcement Officer believes there are violations located within a dwelling on the property;
and the Property Maintenance Enforcement Officer has evidence that shows probable cause that one of the Maintenance Ordinances is being violated.
