(a) No person shall engage in the business of refuse collection, hauling, or disposal for compensation, or as a required or voluntary service for others in the City of Mount Vernon, unless he possesses a permit issued by the Chief of Police or an officer of the Mount Vernon Police Department acting as his designee. In addition, solid waste hauler registration approval for those persons doing business within the City of Mount Vernon will require participation in the curbside recycling program for City residents. The curbside program requires all providers to offer a non- subscription curbside pickup to all of their subscribers except commercial establishments.
(1) Prior to issuance of a permit the solid waste haulers shall file with the application a sworn affidavit that they have notified their customers that the curbside program requires all providers to offer a non-subscription curbside pickup to all their subscribers.
(2) The permit shall include a decal to be conspicuously displayed on the vehicle upon passing the inspection and in a manner and place determined by the issuing officer. The name of the hauler or company shall be displayed on the side of the truck in at least four (4) inch letters.
(b) All solid waste haulers and demolition haulers in the City shall meet the vehicle requirements and purchase the annual license to operate.
(c) The annual fee is twenty-five dollars ($25.00) per truck payable upon filing of the application. Fee to be deposited in the General Fund of the City of Mount Vernon.
(1) A decal that is reported to be lost or damaged may be replaced upon request of the permit holder. An amount of no more than ten dollars ($10.00) shall be charged for this section.
(d) Application for permits shall be made to the Mount Vernon Police Department on a form provided and will include the following information:
(1) Name of person, firm or corporation making application. In case of firm, partnership or corporation, include names of all principal owners and addresses.
(2) The address of the business office and telephone number.
(3) Name and address of liability insurer. Expiration date of policy and amounts of insurance coverage. Liability insurance coverage shall be maintained at the levels indicated in the application process.
(4) Description of equipment to be used in collection or disposal of refuse, area to be served, place and method of disposal, place of transfer to second vehicle (if so planned) and any other such information as the Mount Vernon Police determines will reasonably aid in administration and enforcement of these regulations.
(e) The Chief of the Mount Vernon Police Department may revoke the permit(s) of one or more vehicles of any person, firm, or corporation to operate a refuse collection or disposal service who has demonstrated inability or unwillingness to comply with these regulations or other previously established City Ordinances.
(f) Any person whose application for a permit has been denied, or whose permit has been revoked, or who has been refused the re-issuance of a permit, may make a written request for a hearing before the Solid Waste Haulers Board of Appeals stating his reasons why a permit should be issued or permit not be revoked. The Solid Waste Haulers Board of Appeals shall grant such hearing within a reasonable time after request is made therefore.
(g) All permits issued under these regulations shall expire one year from the date of issuance. Permits shall be eligible for renewal thirty (30) days prior to their expiration. It shall be the responsibility of the permit holder to arrange for the annual inspection of any vehicle with an expiring permit.
(h) Government agencies, political subdivisions and schools are exempt from these requirements.
