(a) As used in this chapter, certain terms are defined as follows:
(1) “The City” means the City of Mount Vernon, Ohio.
(2) City Council means elected City Council Members of City Council.
(3) “Persons” means any individual, firm, corporation, association, partnership, political subdivision or other entity.
(4) “Safety Service Director” means the Safety Service Director of the City of Mount Vernon, Ohio.
(5) The Mount Vernon Police Department means the Chief of the Mount Vernon Police Department or any officer acting as his designee.
(6) The Solid Waste Haulers Board of Appeals includes three persons, the Mount Vernon Mayor or his designee, the Mount Vernon Street Superintendent and a resident of the City recommended by the Mayor and approved by City Council.
(7) "Sanitary landfill disposal" means the systematic and orderly disposal of refuse in an approved site.
(8) "Solid wastes" means such unwanted residual solid or semisolid (i.e., the material in question, while cohesive and viscous, slowly flows or loses its shape when unconfined, and does not readily release liquids, under normal climatic conditions) materials as results from industrial, commercial, agricultural and community operations, excluding earth or material from construction, mining, demolition operations, and slag and other substances which are not harmful or inimical to public health. This includes, but is not limited to, garbage, combustible and non-combustible materials, street dirt and debris, bulky items such as furniture, bed springs, and large appliances.
(9) "Recyclables" means products that can be collected and remanufactured into new products after they have been used. Items to be collected in curbside collection programs are cardboard, office paper, mixed paper, newspaper, magazines, steel containers, aluminum containers, plastic bottles and jugs, glass bottles and jars and aseptic food/beverage containers as outlined in the DKMM Solid Waste Management Plan.
(10) "Non-Subscription" means curbside recycling service is offered to all residents of a particular service area and is automatically included in the cost of waste services.
(11) Single family homes, buildings with four units or less, and all Home Owners Associations (HOA) within the city, are eligible for curbside services.
(12) Curbside pick-up of solid waste and recyclables must be done on a weekly basis.
