357.02 LOADING SPACES FOR BUSINESS; ANNUAL PERMIT AND FEE.
   (a)   A business which meets all of the following criteria may secure from the Director of Public Safety-Service, a loading zone permit on application submitted to the Director as hereinafter provided:
      (1)   Regularly engages in the sale of marketable goods where a substantial portion of such goods are delivered to customers by the vehicle assigned to the loading space.
      (2)   The use of the space will be for a commercially designed or license vehicle for the delivery of the establishments marketable goods.
      (3)   The space must be a necessity for the pickup or delivery of marketable goods in lieu of other alternatives to the loading space.

   (b)   The fee for a permit issued shall be three hundred sixty-five dollars ($365.00) per year. The permit may be renewed annually on January 1st, application directed to the Director. The fee paid on an application filed after January 1st, or any year shall be pro-rated.

   (c)   If the business to which a permit issued requests, a sticker will be issued for use on a motor vehicle utilized by the business. Such sticker shall permit the motor vehicle to utilize the space covered by the loading zone permit. There will be no charge for the first sticker, but additional stickers for additional vehicles utilized in the business may be obtained for fifty dollars ($50.00) per sticker.
   (d)   The Director shall designate the given area in the parking meter zone covered by a loading zone permit, and parking by the general public therein shall be prohibited.
   (e)   The Director shall be authorized to issue only one loading zone permit to any one business unless specifically authorized by a resolution of Council.
   (f)   Any taxicab business or any business dealing with operation of a vehicle for hire or reward shall not be construed as a "business" within the meaning of this section.
   (g)   The Director shall be authorized to rescind the permit if and when any of the above listed criteria is not met. The fees will be pro-rated according to the amount of time the space has been used. (Ord. 1989-20. Passed 6-19-89.)
   (h)   Whoever violates this section and receives a parking ticket shall pay a fine of ten dollars ($10.00).
   (i)   If a parking ticket issued under this section is not paid within five days of the issue date, the fine is raised to twenty dollars ($20.00).
