931.09 OPERATION OF CONCESSION STANDS.
   (a)   Regulations as to the operation of concession stands within Dan Emmett Park, Memorial Park, Riverside Park, Phillips Park and Hiawatha Park excluding Community Pool, being recreational parks within the City are as follows:
      (1)   There shall be no more than one concession stand per ball diamond.
      (2)   Concession stands are to be operated only by those individuals involved with a ball league.
      (3)   All profits are to be directed to the Treasurer of the League operating the concession and those profits are to be used in programs.
   (b)   If by May 1st, of any year no individual associated with a ball league commits to operate a concession stand at a ball field, the Safety-Service Director shall enter into contract for a period of one year for the operating of a concession stand. The contract shall contain the following provisions:
      (1)   Contract shall be for the duration of one year.
      (2)   Ten percent (10%) of all gross receipts shall be paid to the general fund for the City to be used for park equipment.
   (c)   Exceptions to the above regulations may be granted with the approval of the Recreation Board. Upon the approval of the Board a special permit shall be issued by the Safety- Service Director. Such special permit shall be limited to no more than two events per year, per business or individual. Ten percent (10%) of all gross receipts shall be paid to the general fund for the City to be used for park equipment. The ten percent (10%) provision may be waived by the Safety-Service Director for non-profit organizations. Such special permits must be displayed during the permitted event.
