§ 52.114  ADDITIONAL ENFORCEMENT REMEDIES.
   (A)   Performance Bond.  The Superintendent may decline to reissue  a permit to any industrial user which has failed to comply with the provisions of this chapter or any order or previous permit issued hereunder unless such user first files with it a satisfactory performance bond, payable to the POTW, in a sum not to exceed a value determined by the Superintendent to be necessary to achieve consistent compliance.  The performance bond shall be executed by such sureties as are named in the current list of "Companies Holding Certificates of Authority as Acceptable Sureties on Federal Bonds and as Acceptable Reinsuring Companies" as published in Circular 570 (amended) by the Audit Staff, Financial Management Service, Surety Bond Branch, U.S. Treasury Department.  All bonds signed by an agent must be accompanied by a certified copy of such agent's authority to act.
   (B)   Liability Insurance.  The Superintendent may decline to reissue a permit to any industrial user which has failed to comply with the provisions of this chapter or any order or previous permit issued hereunder, unless the industrial user first submits proof that it has obtained financial assistance sufficient to restore or repair POTW damage caused by its discharge.
