§ 91.31 DISPOSITION OF IMPOUNDED DOGS.
   (A)   The owner or person entitled to the custody of any impounded dog, except a dog impounded by § 91.33, may redeem the same at any time before it has been disposed of, as is this subchapter provided, and by having said dog vaccinated for rabies as is hereinafter provided if such dog has not been properly vaccinated, and by paying to the City Clerk-Treasurer a fee of $5 and a maintenance fee of $15 for each day including any fractional day which said dog may have been impounded.
   (B)   The owner or person having custody of any dog impounded pursuant to § 91.33 may redeem that dog not less than ten days after its impoundment upon compliance with the requirements for redemption set out in division (A) above.
   (C)   (1)   Any dog which at the time of its impoundment was wearing a tag and which remains in the pound for five days or more after notice to its owner; or
      (2)   Any dog impounded pursuant to § 91.33 which remains in the pound for more than ten days and which is found not to be diseased; or
      (3)   Any other dog remaining in the pound for more than five days shall be deemed to be abandoned.
   (D)   After a dog is deemed abandoned, the Animal Control Officer may dispose of that dog by:
      (1)   Releasing that dog to a person other than the former owner upon compliance by that person with the requirements of division (A) above; or
      (2)   Destroying the dog by any humane method.
   (E)   Animal Control Officers shall maintain records indicating date of impounding to insure no animal is destroyed or adopted before five days.
   (F)   Due to financial and manpower constraints, notwithstanding § 91.30 or a matter of public safety, the only animal which will be impounded under this chapter is a dog.
