§ 33.128 NEW LATERAL POLICE OFFICER INCENTIVE PAYMENT.
   (A)   Definitions. For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      LATERAL POLICE OFFICER. To be considered a LATERAL POLICE OFFICER under this section, the police officer must:
         (a)   Be a Tier I Certified Officer as defined by the Indiana Law Enforcement Academy (ILEA) and must:
            1.   Be a graduate of an Indiana Tier I Basic Training Academy with written confirmation of completion, without restriction, prior to applying with the Mount Vernon Police Department (MVPD); or
            2.   Be a graduate of an academy recognized by the Indiana Law Enforcement Training Academy (ILEA) as a Tier I Basic Training Academy AND must have completed the Indiana training requirement waiver process AND must possess written confirmation of the waiver issued by ILEA prior to applying with the MVPD; and
         (b)   Be employed as an active, fully sworn, full-time law enforcement officer with full powers of arrest with another state, county, or local municipal law enforcement agency or have been employed as an active, fully sworn, full-time law enforcement officer with full powers of arrest with another state, county, or local municipality law enforcement agency within one year from the date of application with MVPD; and
         (c)   Cannot have been previously employed by the MVPD in any capacity for five years prior to the date of applying with the MVPD.
      PROBATIONARY PERIOD. The first period of time of employment with the MVPD as defined annually in the city's salary ordinance.
   (B)   Lateral police officer payment.
      (1)   If selected for employment, and upon successful completion of all preemployment testing and upon successful completion of all pre-employment requirements of the city, and acceptance into the 1977 Police Officers' and Firefighters' Pension and Disability Fund established under I.C. 36-8-8, and after serving as an active, fully sworn, full-time law enforcement officer with full powers of arrest for the MVPD without any incident of discipline, for the prescribed periods below, a lateral police officer hired by the city will receive a new lateral police officer payment of:
         (a)   Five thousand dollars upon successful completion of the probationary period; and
         (b)   Five thousand dollars upon successful completion of three continuous and consecutive years of service with the MVPD.
      (2)   The lateral police officer payments shall be in addition to the per-annum salary of the lateral police officer set forth in the annual city salary ordinance.
      (3)   A lateral police officer who does not complete all requirements set forth herein shall not be entitled to the lateral police officer payment and no pro-rated payment shall be made to a lateral police officer that does not complete the full periods of employment set forth herein.
