§ 35.33 AMERICAN RESCUE PLAN (ARP) CORONAVIRUS LOCAL FISCAL RECOVERY GRANT FUND.
   (A)   Establishment of the fund. The Common Council of the City of Mount Vernon, Posey County, Indiana, recognizes that a need now exists for the establishment of the non-reverting American Rescue Plan (ARP) Coronavirus Local Fiscal Recovery Grant Fund (ARP Grant Fund) pursuant to I.C. 5-11-1-1 et seq., and to establish a plan to spend the funds pursuant to Section 603 of the ARP.
   (B)   Source of funding. The sources of funding for the newly established fund will include monies allocated to the City of Mount Vernon, IN from the American Rescue Plan Act of 2021 (ARPA). The monies within this fund shall be used for eligible purposes of the ARPA and must be expended by December 31, 2024.
   (C)   Additional appropriation for expenditures. Funds receipted into this fund will require an additional appropriation for expenditure. The fiscal officer will maintain detailed accounting records of the receipt and expenditure of any and all funds deposited and paid from the ARP Grant Fund and provide maintain sufficient records for future audits of the ARP Fund. Expenditures shall be made upon approval of appropriate claim forms.
   (D)   Purpose. The purpose of the ARP funds are to be used for only the following reasons as set forth in Section 603(C) of the ARP in accordance with U.S. Treasury guidance:
      (1)   To respond to the public health emergency with respect to COVID-19 or its negative economic impacts, including assistance to households, small businesses and nonprofits, or to aid to impacted industries such as tourism, travel and hospitality;
      (2)   To provide premium pay to eligible workers of the state, territory or tribal government, metropolitan city, non-entitlement unit of local government, or county that are performing such essential work, or to provide grants to eligible employers that have eligible workers who perform essential work;
      (3)   For the provision of the government services to the extent of the reduction in revenue of such state, territory or tribal government, metropolitan city, non entitlement unit of local government, or county due to the COVID-19 public health emergency, relative to revenues collected in the most recent full fiscal year prior to the emergency. The revenues of the full calendar year of 2019 will be used as the base year to determine the reduction of revenue in the full calendar years of 2020, 2021, 2022, and 2023. Over the covered period, costs incurred for the provision of government services will be limited to the total amount of revenue reduction in these years.
      (4)   To make necessary investments in water, sewer, or broadband infrastructure.
   (E)   Plan for use. The City of Mount Vernon Common Council, Mayor, and Clerk-Treasurer will work together to establish a plan that will provide details for the use of the funds received.
   (F)   Unused funds. Any unused ARP funds shall be paid back to the United States Treasury when
required.
