§ 30.02 EXECUTIVE BRANCH.
   (A)   The Mayor is the city executive and head of the executive branch. The Mayor shall perform the duties and responsibilities prescribed by I.C. 36-4-5, other statutes of the state, and ordinances of the city.
   (B)   The following boards, commissions, and departments are hereby established within the executive branch:
      (1)   Board of Public Works and Safety. The Board of Public Works and Safety shall be the chief administrative body of the city and shall have control of the day-to-day operations of the following executive departments which are hereby established: the Police Department, the Fire Department, the Wastewater Treatment Department, and the Street and Sanitation Department.
         (a)   The Board may, by resolution, delegate to the Mayor the authority to manage the day- to-day operations and supervise the personnel of the above-named departments.
         (b)   The Board shall consist of the Mayor, and if state law permits, two members of the Common Council appointed by the Mayor. If members of the Common Council are prohibited from serving on the Board, the remaining two members shall be appointed by the Mayor as permitted by law. Members of the Board shall serve at the pleasure of the Mayor.
         (c)   The Board shall regularly meet not less than twice per month at those times and places as the Board may set. The Mayor or the other two members may call special meetings of the Board.
      (2)   Park and Recreation Department. A Park and Recreation Department controlled and operated by a Park and Recreation Board is hereby established according to I.C. 36-10-3, which shall be operated as an extended Park and Recreation Department in the unincorporated areas of Black Township pursuant to I.C. 36-10-3-36.
      (3)   Fiscal Department. The Clerk-Treasurer shall be the head of the Fiscal Department and the chief fiscal officer of the city, and shall have the powers and duties prescribed for a Clerk-Treasurer of a third-class city by I.C. 36-4-10 and other statutes. The Clerk-Treasurer shall have the authority to designate the number and classification of employees of the Fiscal Department and the Clerk-Treasurer’s office and to determine the compensation for those employees, subject to the appropriations for that compensation.
      (4)   Department of Law. A Department of Law is hereby established pursuant to I.C. 36-4-9-12. The head of the Department of Law shall be the City Attorney who shall be appointed by and serve at the pleasure of the Mayor.
      (5)   Department of Economic Development. Sections 33.045 through 33.052 establishing an Economic Development Commission are incorporated herein and adopted by reference.
      (6)   Commission on Human Relations. A Commission on Human Relations is hereby created. The purpose of the Commission shall be to hear and investigate grievances against city government when those grievances are based on age, sex, race, ethnic, or religious discrimination and to advise the Mayor, Board of Public Works and Safety, or Common Council as to the resolution of those grievances. The number of members of the Commission shall be determined by the Mayor and the members shall be appointed by the Mayor and serve at his pleasure. The members of the Commission shall elect from their number a president and secretary.
      (7)   Mayor’s Youth Advisory Council. A Youth Advisory Council to consult with city officials concerning matters of mutual interest to the city and its young people is hereby established as described in §§ 33.090 and 33.091, and the Mayor is authorized to appoint members to the Youth Advisory Council as he sees fit. The members so appointed shall serve at the pleasure of the Mayor and shall select from their number a chairperson and a secretary.
      (8)   Water Utility Board. The provisions of §§ 33.135 and 33.136 establishing the members of the Common Council as a Water Utility Board for the purpose of managing the city-owned water utility are hereby ratified and confirmed.
      (9)   Parking Meter Department. A Parking Meter Department is hereby established to administer and operate any parking meters in the city as may be established by the traffic code. The head of the Department and the employees thereof shall be appointed by the Mayor and serve at his pleasure.
      (10)   Statutory boards and commissions. The city shall have:
         (a)   A Police Pension Board of Trustees to perform the duties established by I.C. 36-8-6 and I.C. 36-8-8, which shall be constituted and governed as prescribed by statute.
         (b)   A Firefighters’ Pension Board of Trustees to perform the duties set forth in I.C. 36-8-7 and I.C. 36-8-8 is hereby established.
         (c)   Any other boards and commissions required by statute with those boards having the duties and being constituted as prescribed by statute.
   (C)   The heads of the departments named in division (B) (1), (2), and (4) of this section shall be appointed by and serve at the pleasure of the Mayor, subject to the provisions of applicable statutes. However, the Mayor’s appointment of a department head shall be subject to the approval of any statutory board or commission established within the department as set forth in I.C. 36-4-9-2(a).
   (D)   The boards and commissions designated in this section to control certain departments shall have the authority to:
      (1)   Designate the number, classifications, duties, and compensation of employees within the designated departments provided that in fixing compensation, such boards and commissions shall have no authority to exceed amounts appropriated for compensation of employees of that department;
      (2)   Appoint and discharge employees except the heads of those departments; and
      (3)   Delegate to the department head the authority to hire or discharge employees.
   (E)   If no board or commission is assigned the responsibility by this chapter or by statute for a department within the city, the department shall be under the control and supervision of the Mayor.
