§ 97.18 OBSTRUCTION OF SIDEWALKS, EXCEPTIONS.
   (A)   Obstructions shall be unlawful. It shall be unlawful for any person to obstruct any sidewalk by placing thereon or permitting to remain thereon or therein anything which will obstruct free use thereof by pedestrians.
   (B)   Merchant regulations. Notwithstanding division (A) above, it shall not be a violation of said section for a merchant to display his or her wares on the sidewalk immediately in front of his or her place of business located within the business section of the city so long as there remains at least six feet in even width parallel to the street unobstructed for pedestrian movement along the sidewalk and at least three feet in even width every ten feet perpendicular to the street unobstructed for pedestrian movement across the sidewalk from the street. However, no obstruction may exist within three feet of the curb line of the street.
   (C)   Not-for-profit fund-raising. Notwithstanding division (A) above, any social, educational, charitable, religious or other not-for-profit organization may conduct fund-raising sales and other activities which do not violate the restrictions of division (B), provided that they obtain the consent of any place of business in front of whose business such activity will be conducted and that such activity shall be conducted during normal business hours.
   (D)   Barricaded sidewalks for special events. The prohibitions and requirements of this section shall not apply to the use of sidewalks by vendors, displayers, other persons or organizations during special events for which the Board of Public Works and Safety has authorized the barricade of the sidewalk for the special event. During such special event, the vendor, displayer, person or organization using the sidewalk shall not block a business entrance or exit.
   (E)   Penalty. Any person neglecting or refusing to comply with the provisions of this section shall be subject to general penalty provisions of this code in § 97.99.
