(A) There is created a special nonreverting operating fund to be used for the operation and development of sports, recreation programs, and programs of recreational classes and instruction by the Parks and Recreation Department of the city and Black Township, pursuant to I.C. 36-10-3-22.
(B) The income from fees paid by participants in the sports and recreational programs, user fees, recreational instruction programs, and other funds shall, to the extent permitted by statute, be deposited in the nonreverting operating fund created by this section if the disposition is approved by the Parks and Recreation Department. Such funds may be expended without appropriation to pay officials, instructors, and other costs of the sports and recreation programs and classes.
