§ 156.133 COVERED AREAS IN ANY ZONING DISTRICT IN WHICH OVERHEAD LINES HAVE BEEN PLACED UNDERGROUND.
   (A)   The town is currently engaged in having certain overhead utility lines placed underground for aesthetic and enhanced service reasons.
   (B)   Within 90 days following written notice from the town, any wireless service provider shall, at its own expense, disconnect, remove, relocate, change or alter the position of any SWF within the rights-of-way whenever the town, in the reasonable exercise of it police powers, has determined that such removal, relocation, change or alteration, is reasonably necessary to meet the objectives of having the overhead utility lines being placed underground and will ensure public health, safety, and welfare. Subject to the above and upon a determination by Planning staff, applicant may be allowed to replace any SWF with a decorative style support structure, meeting decorative pole appearance, materials, concealment and underground support structure requirements in compliance with this subchapter.
