§ 117.05 APPROVAL PROCEDURE AND CONDITIONS.
   The Town Administrator, or his or her designee, shall review the application and, should the application be complete, forward the same with recommendations to Town Council. Town Council shall review the application in accordance with the criteria provided in § 117.06. Approval, rejection or conditional approval of an application shall be at the sole discretion of Town Council. Any conditions imposed by Town Council shall be reduced to writing and acknowledged in writing by the applicant as conditions precedent to any incentive. No incentive grant shall be payable prior to the issuance of a certificate of occupancy. If the business project is to be phased, the incentive grant shall likewise be phased and payable in amounts proportional to the applicable phase of the project as certificates of occupancy are issued for the applicable phase. In the event a certificate of occupancy is not required, no incentive grant shall be payable until the applicant’s business license fees have been paid in full.
