(A) Except as provided in division (B) below, it shall be unlawful for any person, firm or corporation to tunnel under or to make any excavation in any street, alley or other public place in the village without having obtained a permit as is herein required or without complying with the provisions of this subchapter or in violation of or variance from the terms of any such permit.
(B) No permit shall be required by any person, firm or corporation for the maintenance, upgrading and repair of previously constructed improvements. Such person, firm or corporation shall provide notice of excavation in accordance with the laws of the State of Illinois.
