A Non-Commercial Solar Energy Facility shall constitute a structure that requires a Building Permit and is permitted in all Zoning Districts and shall, except as hereinafter provided, be subject to the general provisions of the Zoning District, including setback requirements, in which it is situated. In addition, a Non-Commercial Solar Energy Facility shall comply with all applicable local, state and federal regulatory standards, codes, and laws. A Non-Commercial Solar Energy Facility that is ground installed shall have no component of a solar panel that has a height of more than 10 feet above ground when the solar energy facility’s arrays are at full tilt; a non-ground installed (i.e. building mounted) Non-Commercial Solar Energy Facility shall have no component of a solar panel that has a height of more than 3 feet above the building roof line or other building installation surface when the solar energy facility’s arrays are at full tilt and shall not extend beyond the edge of the roof or surface. A Non-Commercial Solar Energy Facility’s power and communication lines running between banks of solar panels and to electric substations or interconnections with buildings shall be buried underground. A Non-Commercial Solar Energy Facility shall be designed and located so as to prevent glare from any individual arrays/solar panels toward any inhabited building on adjacent properties as well as adjacent street rights-of-way. A Non-Commercial Solar Energy Facility shall have such vegetative ground cover or other measures as is needed to reduce or prevent stormwater runoff, flooding, and/or erosion.
