(A) (1) The City Manager may issue a Show Cause Order to a user which has violated or continues to violate any provision of this ordinance, a wastewater discharge permit or order issued hereunder, or any other pretreatment standard or requirement. The Show Cause Order shall require the user to appear at a Hearing before the City Council to show cause why the POTW should not disconnect service, revoke or suspend the user’s wastewater discharge permit or seek injunctive relief to prohibit the user from discharging to the POTW.
(2) The City Manager may also, upon discovering an ongoing or potential discharge to the POTW which presents or may present a danger to the health or welfare of persons, to the environment or causes interference with the operation of the POTW, issue a Show Cause Order to the user to appear at a Hearing before the City Council to show cause why the POTW should not disconnect service, revoke or suspend the user’s wastewater discharge permit or seek injunctive relief to prohibit the user from discharging to the POTW.
(B) The Show Cause Order shall specify the time and place for the Show Cause Hearing, the proposed enforcement action, the reasons for such action, and the purpose of the Hearing (i.e. to allow the user to show cause why such action should not be taken). The Show Cause Order shall be served personally or by registered or certified mail (return receipt requested) at least five (5) days prior to the scheduled date of the Show Cause Hearing. The Show Cause Order may be served on any authorized representative of the user. A Show Cause Hearing shall not be a bar against, or prerequisite for, taking any other action against the user.
(C) Procedures to be followed by the City Council in said show cause hearing shall be in accordance with § 52.167(B) of this ordinance. After said hearing, the POTW may disconnect service, revoke or suspend the wastewater discharge permit or seek injunctive relief to prohibit the industrial user from making the discharge to the POTW.
