§ 161.390 PREAMBLE.

   (A)   WHEREAS, the Illinois General Assembly enacted Public Act 100-0585, known as the Small Wireless Facilities Deployment Act (50 ILCS 835), having an effective date of June 1, 2018, which has been moved to 50 ILCS 840/; and

   (B)   WHEREAS, the City of Mount Vernon, Illinois (the City) is an Illinois municipality in accordance with the Constitution of the State of Illinois of 1970; and

   (C)   WHEREAS, the City is authorized, under existing State and federal law, to enact appropriate regulations and restrictions relative to small wireless facilities, distributed antenna systems and other personal wireless telecommunication facility installations in the public right-of-way as long as it does not conflict with State and federal law; and

   (D)   WHEREAS, the Illinois Small Wireless Facilities Deployment Act preempts home rule authority and sets forth the requirements for the collocation of small wireless facilities by local authorities; and

   (E)   WHEREAS, this §§ 161.390 through 161.397 implements the requirements of the Illinois Small Wireless Facilities Deployment Act.
