(A) Except as otherwise herein set forth, this chapter shall not apply to the following situations:
(1) When a minor is accompanied by a parent of such minor;
(2) When a minor, who is a duly authorized and licensed driver, is operating a motor vehicle within the city for the purpose of passing through, by direct route, from one location to another either within or out of the city, including all minors that may be also within the vehicle, in a vehicle involved in interstate travel;
(3) When a minor is returning home, by a direct route from, and within one hour of the termination of, a school activity, or any activity of a religious, civic, or other voluntary association, providing that justification indicating time of termination of such event can be given to any investigating officer of the Police Department;
(4) When a minor is on the sidewalk or property where the minor resides, or on either side of or across the street from the place where the minor resides and the adult owner or resident of that property has given permission for the minor to be there;
(5) In case of reasonable necessity for the minor remaining in a public place but only after the minor's parent has communicated to the Chief of Police or the person designated by the Chief of Police to receive such notifications the facts establishing the reasonable necessity relating to a specified public place at a designated time for a described purpose including points of origin and destination. If the reasonable necessity arises out of a special event, it shall be sufficient if the sponsor of the special event, rather than the parent of each attending minor, makes such communication to the Chief of Police. A copy of the communication, or of the police record thereof, duly certified by the Chief of Police to be correct, with an appropriate notation of the time it was received and of the names and addresses of the parent and minor or of the sponsor, as the case may be, shall be admissible evidence;
(6) When a minor is involved in an employment activity, or going to or returning home from an employment activity, without any detour or stop;
(7) A minor who is married or had been married; or
(8) A minor who is involved in an emergency.
(C) It is a defense to prosecution under § 132.31 that the owner, operator or employee of a business establishment promptly notified the Police Department that a minor was present on the premises of the establishment during curfew hours and refused to leave.
