§ 35.21 EMERGENCY MEDICAL SERVICE; ESTABLISHMENT; MEMBERS; DUTIES.
   (A)   There is established an Emergency Medical Service of the city.
   (B)   The Emergency Medical Service shall be composed of one captain, three lieutenants, and a number of squad members to be determined by the Mayor and City Manager.
   (C)   The members of the Emergency Medical Service as provided by (A) above shall be appointed by the Mayor, with the approval of Council.
   (D)   The captain of the Emergency Medical Service shall have exclusive control of the stationing and transferring of all squad members and officers under his command.
   (E)   The captain shall provide leadership, management, command, technical information, and current instructions and training in all phases of emergency medical care and services.
   (F)   The captain may appoint a lieutenant to serve as officer in charge during any absence of the captain.
   (G)   The three lieutenants shall report directly to the captain. The lieutenants shall have miscellaneous duties such as training, scheduling of personnel, equipment maintenance, inventory, payroll, insurance, or whatever duties are assigned to them to maintain an efficient and orderly operation of the Emergency Medical Service.
   (H)   The Emergency Medical Service shall function primarily for and in the city. The Emergency Medical Service shall, when dispatched, respond to other locations outside the city under mutual aid agreements and shall in time of a major disaster volunteer its manpower and equipment, if needed, provided that all mutual aid assistance must be approved by the captain and City Manager.
   (I)   Any and all equipment necessary for administering life-saving and efficient operation of the emergency medical service and its personnel shall be purchased only after joint recommendation of the captain and City Manager.
   (J)   The emergency medical service shall be composed of volunteer members. The rate of compensation for all members of the emergency medical service shall be as established by Council. All changes and reviews in rate of compensation must be done jointly by the captain and City Manager, with their joint recommendation then being presented to Council.
   (K)   The members of the Emergency Medical Service when performing their official duties or responding to an emergency shall be considered as performing a governmental function as provided by R.C. § 737.04.
   (L)   The captain of the Emergency Medical Service shall be appointed by the Mayor.
   (M)   The captain of the Emergency Medical Service shall appoint the lieutenants.
